Consultation Agreement

YOUR OWN DETAILS:

This Initial Consultation Agreement sets forth the terms and conditions of the initial consultation meeting between Natalie Phan Law, LLC (“we” or “us”) and you, the client:

 

I. Purpose. The purpose of the initial consultation is for Natalie Phan Law, LLC

(a) to learn about you and your particular legal needs based on the information you provide;

(b) to answer your questions to the best of our ability;

(c) to identify your options and, to the extent possible, analyze the costs and benefits of those alternatives;

(d) to help you determine your course of action if any;

(e) to discuss our fees and terms of representation if an attorney-client relationship is to be established after the meeting; and

(f) to determine the next steps in the process, as appropriate.

 

II. Nature of Representation. The attorney will provide consultation to you with regard to your legal need, if necessary and called for in the opinion of the Attorney.

 

III. Scope of Representation. The term of this engagement is for 60 minutes. Services will include the following:

  • One-time 60 minutes consultation with the Client.

  • Review of pertinent pleadings available for inspection.

  • Analysis and assessment of the situation and development of a plan or course of proceeding based upon information available. The scope of representation does NOT include communications with the Client and others after the date of the contract, settlement, and drafting documents; or representation in any legal proceeding. The terms of this contract expire upon the conclusion of the initial consultation.

 

The Attorney has not been retained on any other matter and has no responsibility to the Client on any other matters unless specifically agreed to in writing. The scope of our representation is limited to the consultation and assessment set forth above. At the conclusion of the initial consultation, there is no obligation for you to retain us, nor does Natalie Phan Law, LLC has an obligation to provide services to the Client unless mutually agreed in writing.

 

IV. Engagement Agreement Required. Following the initial consultation, if you agree to retain us, and if Natalie Phan Law, LLC agrees to provide services to you, then we will prepare a separate, more detailed Engagement Agreement to be executed by both parties. The new Engagement Agreement will supersede this Initial Consultation Agreement and will set forth the terms and conditions of our representation of you, including our fees and the specific services to be performed by us.

 

V. Waiver. The Client specifically and expressly waives the attorney-client privilege to allow the attorney to perform the legal work properly. Exceptions to this waiver must be stated in writing by the Client. The Client also authorizes the attorney and staff to obtain confidential information about the Client from witnesses and other sources, if necessary, for proper preparation of the assessment.

 

VI. Flat Fee. The fee for the initial consultation shall be a flat fee of $200 for phone consultation or $250 for in-person consultation, the full amount must be paid 48 hours before the scheduled initial consultation appointment. All amounts paid are nonrefundable and final. The Client agrees that the experience, reputation, and ability of Natalie Phan Law, LLC merits payment of the foregoing fees. The Client has sought out the representation of Natalie Phan Law, LLC with the understanding and intent that the highest level of fees is required. This fee is to compensate Natalie Phan Law, LLC for acceptance of employment and foregoing other employment, such as the opposing party. Such fee shall be deemed earned upon receipt and may be immediately deposited in the operating funds of Natalie Phan Law, LLC.

 

VII. Severability. The provisions of this agreement are severable. This means that if one or more provisions of this agreement are found to be void or unenforceable for any reason, the remaining provisions of this agreement will still apply.

 

THIS IS A LEGALLY BINDING CONTRACT. THE CLIENT HAS THE RIGHT TO SEEK INDEPENDENT COUNSEL FROM ANOTHER ATTORNEY BEFORE SIGNING IT.
